11-Year-Old Girl Child Molested in Kalimpong
SPECIAL REPORT: Nisha V Chettri
After an incident of molestation to a minor that came to light through social networking sites, the accused allegedly identified as Govind Sarki has been absconding, while the little survivor admits that she was molested.
Sarki is known to be a driver (Driving white WagonR) by profession, living with a wife and daughter of two. According to the information received from the survivor’s family, the mother, who suffers from fluency disorder, used to walk her towards her school every day. On Friday, Sakri coincidently was around their locality and volunteered to drop the girl to her school, which he used to do once in a while.
On the way to her school, he stopped the car in an isolated area, came out of the driver’s seat, got in the second seat, locked the door, removed her shirt and molested her. It was known that she was alone in the car.
She returned home later in the (Friday) evening and told her mother about the incident, her mother, on the other hand, was not (fully) believed by her family members because of her disorder.
On Sunday, when the family members prepared to give the girl a bath, they asked her about the incident and she said everything slowly. The family members later took her to Sarki’s house to identify him, he was not present. When his photo was shown, she started shivering with fear, informed the family members. They filed an FIR later in the evening on Sunday and admitted her at the District Hospital for her medicals.
‘He also bit her in sensitive parts of the body’ said the family source, while the survivor was nodding behind her at the District Hospital when asked her, ‘How old are you?’ she responded ‘I am turning 11 soon’
It was also known that he gave her 10 rupees before and after he abused her. Sarki, on the other hand, has been absconding ever since the incident
‘If the kid is lying or unsure, why would he abscond after the incident?’ questioned the family members.
However, as per the verbal order of Child Welfare Committee-Alipurduar, (In-Charge Kalimpong), she was sent to Bal Suraksha Abhiyan (An NGO) in the evening, for the temporary shelter.
The case is filed in the Women Police Station and the police sources said that they are investigating in the matter.

Forest Rights Activist Transferred - Says "Its Vendetta Politics"
Residents of nearly 24 odd forest villages that fall under the Gorkhaland Territorial Administration have been demanding the implementation of the Forest Rights Act 2006 before the Sevoke-Rangpo rail project kicks off. A major portion of the railway tracks between Sevoke, around 30 km away from Siliguri, to Rangpo in Sikkim is a part of Darjeeling and Kalimpong districts that are under the GTA and will cut through several forest villages and hamlets under the GTA areas.
Fighting for their rights is Himalaya Forest Village Organisation (HFVO) which comprises of members from forest villagers in the GTA region.
HFVO Secretary Mr. Lila Kumar Gurung who is a teacher at the local Kumai High School has now been transferred to Rimbick [You can check the transfer order here: https://khabarmagazine.com/archives/21396]. He claims this is a vendetta, for taking a stand in favour of the forest dwellers and asking the government to provide land rights to forest dwellers under the Forest Rights Act 2006.
The situation in the hills and terai is complicated because Panchayat elections haven't been held here since 2005. In the absence of Gram Sabhas, which can give a go-ahead to such projects, the Union ministry of tribal affairs had given elected GTA members the right to act as panchayat members. However, since GTA stands dissolved, the Gram Sabha - comprising of all the villagers naturally have the latitude to issue or deny such a no-objection certificate.
Hundreds of residents of forest villages in Kalimpong and Darjeeling, which constitute the Gram Sabhas as per the Recognition of the Forest Rights Act 2006, have started adopting resolutions, demanding conversion of forest villages into revenue villages to ensure their rights, before they issue the no-objection certificate.
The villagers have stated that they would not allow the authorities concerned to begin construction of the railway project without the NOC from each Gram Sabha. They further claimed that authorities cannot carry out work there without the NOC from the Gram Sabha, and that the GTA does not have the right to issue the NOC to the railway authorities for the forest land.
There are no three-tier elected bodies in the Hills of Darjeeling and Kalimpong as rural polls have not been held there for the past 18 years due to technical and legal matters which have yet to be resolved. As a result, there are no proper records of the Gram Sabha comprising at least 165 forest villages.
According to sources, 24 of the 165 forest villages will be affected by the tunnel to be dug for the railway project.
“When the administration has converted forest villages into revenue villages in Alipurduar and other districts for other projects, no initiative was taken to ensure forest rights for us in Darjeeling and Kalimpong district,” said Mr. Lila Kumar Gurung recently, following GTA Board of Administrator Chairman Binay Tamang's extreme reaction to him and HFVO in Kalimpong.
Mr. Gurung has further claimed that a conspiracy was being hatched to deprive the forest villagers of their rights. “We had met the then GTA chief executive Bimal Gurung and discussed the matter. Mr. Gurung had taken a decision in our favour, and it was decided that all the 165 villages would be converted into revenue villages.
Later, as Binoy Tamang was appointed as the GTA chairman, we also approached him in writing. But we came to know all of a sudden that he will issue the NOC to the railway authorities,” he further claimed.
Forest villagers from Rangpo, Kinley, Melli, Teesta, Rambhi and some others also claimed that they had written to chief minister Mamata Banerjee, demanding that forest villagers’ rights be ensured before implementing the Sevoke-Rango railway link project.
A resident of Rangpo village in Kalimpong area, Smaran Rai, said: “Villagers are worried about their future following continuous threats from the administration during a survey on the railway project.
Nobody knows what is in store for them, rehabilitation and alternative livelihood.” “Residents living in the small stretch (of the project) that falls in Sikkim are not facing such problems. The Sikkim government has already compensated them properly,” Mr. Rai said.
A rights activist Soumitra Ghosh said the present situation in the Hills is “not suitable” for some persons to assemble in a particular place and demand their fundamental right.
“Where will the forest villages go, seeking justice? Authorities have not yet started talking to villagers, when no work can be carried out without the NOC from the Gram Sabha as per a circular of the Union Ministry of Environment and Forests under the Forest (Conservation) Act 1980, ensuring compliance of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006,” he said.
Speaking against the transfer, Mr. Neeraj Zimba of GNLF said, "This transfer order of Sri. Lila Kumar Gurung, General Secretary, Himalayan Forest Villager's Organisation from Kumai High School to Rimbick High School is part of Binay Tamang's "Political Deal(ing)" as openly declared by him recently at public meetings in Kurseong, Kalimpong and Bijanbari respectively. For the first time in the history of Gorkha Politics we have ever seen a Nominated Stooge openly declare from a public platform that he will politically victimise all those who doesn't support him and endorse his views. Mockery of Democratic values and free speech.
All Should Protest Against this as this is not just a routine exercise or a mutual transfer but political victimization of a person who chose to speak truth to the power - a right which has been given rightly by the Constitution." [sic]
Mr. Lila Kumar Gurung in the meanwhile seems to be unflustered with the transfer order and said, "I am a teacher - my primary duty is to teach and I will do that anywhere. They must assume by transferring me to Rimbick they will weaken the movement, but they are wrong. The movement will only grow stronger. Rimbick is comprised of many forest villages that are also deprived, I look forward to working with those villages and organize them to seek inclusion into FRA 2006 at the earliest".
Darjeeling, Kalimpong to benefit from 'Nijo Griho Nijo Bhumi Prokolpo'
Darjeeling: Now, Darjeeling and Kalimpong will finally benefit from "Nijo Griho Nijo Bhumi Prokolpo" of the Bengal government.
The scheme is being routed through the Gorkhaland Territorial Administration in the Hills. The "Nijo Griho Nijo Bhumi Prokolpo" was launched on October 18, 2011 by the Chief Minister of Bengal, whereby 5 decimal of land is provided to the homeless, landless beneficiaries.
"This scheme along with the rest of Bengal was earlier available in the GTA area. Initially 25% of the applicants benefitted from the scheme. However, the scheme was stopped under the GTA. We have decided to reintroduce the scheme again through the GTA and have been given a go ahead by the State Government," stated Binay Tamang, Chairman, GTA.
In a meeting on May 14, the GTA and state government officials decided to reintroduce this scheme in the Hills. A follow up meeting was held at the GTA Chairman's office in Darjeeling on Friday attended by Land reform Officers, Block Officers and GTA officials.
"Application made earlier will also be processed along with fresh ones. Earlier there was hardly any promotion of the scheme in the Hills, hardly anyone knew about the scheme. This time, we will be giving advertisements in newspapers and TV channels so that people come to know about the scheme and the deserving ones get the benefit," added Tamang.
Applicants can submit applications in Block Offices, Block Land and Land Reforms Office and Gram Panchayat offices as per their convenience.
Committees have been constituted in each of the 8 blocks comprising Block Development Officer, Block Land and Land Reforms Officer and a member of the Board of Administrators, GTA.
Applications for the Kalimpong 1, Kurseong, Mirik, Sukhiapokhari, Rungli Rungliot and Darjeeling - Poolbazar Block will be received from June 4 to June 9. For Kalimpong 2 block, it will be from June 11 to 16 and for Gorubathan block from June 18 to 23.
The applications will be scrutinised by the committee formed in each block and then will be recommended by the Sub Divisional Land and Land Reforms Officer to the GTA. The GTA will then forward the list to the state following which land documents will be handed over by the state government.
When questioned on the fate of tea garden workers, who have been demanding documents since long, Tamang stated: "Tea gardens are leased land of the State Government. The workers can apply. The concerned departments and the state government will then decide," added Tamang.

Rohingya entry in the hill rumours, says Binoy Tamang
SNS, Darjeeling/Kurseong, 29 April 2018: The chairman of the Gorkhaland Territorial Administration (GTA) Board of Administrators, Binoy Tarnang, has put to rest speculations that a group of Rohingya Muslims may have found their way up to the Hills.
Two youth leaders of a national party and some other local leaders and political parties have been misleading the Hill people by highlighting the Rohingyas in a wrong way for their own vested interests and keeping in mind the upcoming 2015 parliamentary elections," he said at a programme in Kurseong yesterday.
A video showing a group of Muslims getting down from a bus in Kalimpong had gone viral very recently, fuelling speculations that they may be Rohingya refugees.
Fugitive leader of the Gorkha Jan Mukti Morcha (GJMM) Bimal Gurung had alleged that the state government may have been trying to have Rohiugyas settled down in the region, while leader of the Akhil Bharatiya Gorkha League, Pratap Khati had written to the Kalmpong District Magistrate and the Superintendent of Police, urging them to look into the matter.
"The people who have reached Kalimpong are actually Indian citizens and students from a polytechnic college in Kolkata who have come to visit the place." Mr. Tamang said, adding that as the GTA chairman,he has been monitoring the issue seriously.
According to him, he will leave the GTA if anybody provides him proof of even a single camp of Rohingyas in Darjeeling Hills.
Defending the state government, Mr Tamang said that Darjeeling Hills or North Bengal is surrounded by international borders guarded by central forces and "not by the state government or Nabanna."
Mr. Tamang also issued a press release today and said that the rumours were the handiwork of political parties outside Darjeeling, which have set their eyes on the 2019 Lok Sabha elections.
"This is a ploy of parties outside Darjeeling to destabilize the Hills that are gradually getting back to normal (after last year's violent Gorkhaland agitation), while these parties have set their eyes on the 2019 general elections and are trying to take political mileage by spreading violence again." Mr Tamang said. He further urged all the Hill people to ignore such false campaign and rumours and keep intact Darjeeling unity and communal harmony.

Kalimpong’s poisonous mushrooms: Deaths toll 5, bodies exhumed for postmortem
The death toll from eating poisonous mushrooms in Samsing in Kalimpong district has gone up to five. Seven persons of two families in the Samsing forest compound had eaten the wild mushroom for dinner on Wednesday last.
“The sons of the two families had gone to fix their water connection nearby, while they brought home mushrooms from the nearby woods as they returned,” local sources said.
It is learnt that Navi Bhujel, 60, his wife Sheela Bhujel, 58 and their son Mandeep Bhujel, 19 died undergoing treatment in a Siliguri hospital, while Shyam Kumar Rai, 68, died on Friday, and his wife Ashamaya Rai, 61, died on Saturday.
Though their bodies were buried on Sunday, police exhumed them yesterday for carrying out a post-mortem, sources said. It is also learnt that Rai’s sons Chetan Rai, 28, and Amit Rai, 19, are in a critical condition in a private nursing home in Siliguri.
The Superintendent of the Kalimpong district hospital, Dr Ankan Simlandi, said postmortem on the bodies was a must. “Four bodies were brought to Kalimpong yesterday, out of which, two had to undergo forensic tests. However, as there is no forensic lab here, the bodies were sent to Siliguri on Tuesday,” he said.

Kalimpong movie Appa to feature Daya Hang Rai
“The idea behind the film is to change the way our society looks at a father-son relationship,” Mr Gurung says. The shooting is scheduled to begin on 25 April at the historic Ghoom Railway Station in Darjeeling, while portions of the movie will also be shots in places like Sandakphu and Kalimpong.
“The main characters will be portrayed by Daya Hang Rai who has changed Nepali cinema’s dimensions, the legendary Tulsi Ghimiray the popular actor and filmmaker Aruna Karki,” Mr Gurung told reports here on Monday.
According to him, the shooting may wind up in 60 days, but the post-production process may take a year. “As such, we plan to release the movie on Father’s Day next year,” he said.
Mr Rai, meanwhile, said he is officially acting in India for the first time and that the story line of the film compelled him to sign it. “I was mesmerized by the story I listened to after Anmol Gurung sent it to me in an audio message format, and I did not want to miss an opportunity to work in it.
The subject is universal and people from all across the world can get connected to it,” the Nepalese actor said. Iconic filmmaker, Mr Ghimiray, who had said in the past that Nepal’s cinema and the cinema in Darjeeling Hills had a huge gap, on Monday said the standard of filmmaking here had radically gone up, with good technicians and actors fast coming up.

Sillery in Kalimpong entirely depends on Village Tourism
Sillery, a tiny hamet, nestled at a height of 6000 Ft used to be a home to just four families working in Cinchona plantation. Today, this village has grown big and has around 32 families and its slowing booming as the major village tourism destination. Its name has been derived from the plant that used to grow abundantly in the region. The plantation of Cinchona plant was started by the British in this region to derive Quinine to fight Malaria and is still cultivated today.
This village is located 25 Km away from kalimpong town and is famous for its clean eco-friendly homestays surrounded with tall pine trees, which right away takes you to a surreal world where you can slow yourself down and be lost and relax all day long. The mesmerizing view of Kanchenjunga, short trekking trails and rural lifestyle experience are some of its main attractions that brings tourist from far away.
Even though today Sillery is entirely dependent on village-tourisim, its amazing to see how this village have adapted themselves and welcomed the change by making a conscious effort of keeping it clean and simple without disturbing their daily rural lifestyle.

Rift between Jan Andolan Party (JAP) and the Trinamool Congress Began
Darjeeling, Sept. 26:In an obvious sign of relations souring up between the Jan Andolan Party and the Trinamool Congress, the JAP today rebuffed the TMC’s attempts to make inroads in the hills, asserting no national-level party would be able to usurp power in the region.
The latest swipe comes in the wake of chief minister Mamata Banerjee recently clarifying in a public programme that it was her and her government’s decision to form a separate Kalimpong district.
“We (hills) cherish regional feelings and sentiments when it comes to politics, whatever parties we may be associated with. No national party has been able to rule in the hills as the history of the place shows,” asserted Amar Lama, senior JAP bureau member, today durig a press briefing in Darjeeling.
Going a step further, Lama challenged the TMC to form the government in Tripura first. “Why, Darjeeling hills, we challenge the TMC to first form government in Tripura,” the JAP leader said.
Rift between Jan Andolan Party (JAP) and the Trinamool Congress Began |
Coming out in defence of the party’s president, Lama reiterated that it was the strong pitch made by JAP chief Harka Bahadur Chhetri and the District Demand Committee (DDC) that made the state government decide to create Kalimpong district. “Our party president and the DDC pursued the issue of creating a Kalimpong district relentlessly. It was this untiring effort and pursuance that gave the state government the impetus to come to a decision. The chief minister cannot deny this fact,” said Lama.
The JAP has all along taken credit for the state government's decision to form a Kalimpong district, which apparently was not announced by the chief minister during her latest three-day visit to the hills,
much against popular expectations. Speaing at a programme organised by the Lepcha development board in Kalimpong, Banerjee clarified that nobody had pursued the matter with her to create Kalimpong district. Interestingly, Chhetri who is also the Kalimpong MLA, was among the invitees to the function and was seated on the dais when Banerjee uttered her statement.
The JAP president initially dabbled for a Kalimpong district as a member of the DDC after severing ties with the GJM before he went on to float the JAP to contest the assembly election riding on the Kalimpong district issue. Lama also took offence to the war of words between the state government and the GJM over allocation of funds to the Gorkhaland Territorial Administration. He said,
“Rather than indulging in making claims and allegations, the state government should ask the Comptroller Auditor General to audit the expenditure accounts of the GTA. It can be done on the basis of section 55, clause 9 of the GTA Act under the Funds and Audit section." Lama also suggested that if at all anomalies were found in the audit, the GTA Sabha should be dissolved then.
Mamata Banerjee has claimed that the state government had allocated Rs 4,000 crore to the GTA for development over a period of four years since the formation of the council in 2012. Refuting the claim, GJM president Bimal Gurung has announced a 12 hour strike in the hills on September 28, seeking a clarification from the state government.

JAP raps GTA & Mamata on funds
Darjeeling, Sept. 26: The Jana Andolan Party today accused both Mamata Banerjee and Bimal Gurung of indulging in politics over the GTA funds and asked the state government to conduct an audit of the hill body.
Amar Lama, a bureau member of the JAP, today said: "The chief minister had come up with a Rs 1,000 crore figure during a public meeting in Kurseong in March and after a few months, she talks about Rs 4,000 crore in Kalimpong. Instead of speaking on an issue like this at a public gathering, the chief minister should act seriously. The state government should ask the CAG to conduct an audit and if they find financial irregularities, the state should supersede the GTA as is laid out in the Act."
Lama further said the chief minister was raising the funds issue only when her relation with the Morcha was on the rocks. "Why is the issue being raised only when the relation between the two parties has hit a low? Had the relation (between the Morcha and Trinamul) been steady, it seems, the chief minister would have never raised the issue," said Lama.
In the recent Assembly elections, the JAP was in an alliance with the Trinamul Congress.
Accusing the Morcha of failing to be transparent, Lama said: "The Morcha must be transparent on the issue. The GTA, which is controlled by the Morcha, should give a proper reply to funds queries and should not hide details on money matters. However, there was no need to call a general strike on an issue related to claims and counter-claims on funds."
Late in the evening, Roshan Giri, the general secretary of the Morcha, said the Wednesday strike was also to strengthen the voice of Gorkhaland, which the state government was trying to scuttle in all possible ways. - Telegraph
